Minfour Terms of Service

1. Parties and Acceptance

These Terms of Service ("Agreement") form a binding contract between REKA YAZILIM TURIZM TICARET VE SANAYI A.S. ("Minfour", "we", "us") and you, the natural person ("User", "you") who downloads, accesses or uses the Minfour mobile application ("App", "Service").

By creating an account or otherwise using the App you confirm that you have read, understood and accepted this Agreement. If you do not agree, do not use the App.

2. Description of the Service

Minfour is a social networking platform that lets users create and join group meet-ups consisting of 4 to 15 people for activities such as dinners, coffee, drinks or events. The App offers profile creation, gathering discovery, group chat, venue browsing and a premium subscription.

Minfour is not an organiser of meet-ups; it is an intermediary platform that provides communication infrastructure between users. The actual meet-up, venue booking, expense splitting and any in-person dispute is the sole responsibility of the users involved.

3. Account Creation and Age Requirement

3.1 Age

You must be at least 17 years old to use Minfour. Misrepresenting your age will result in account termination and data deletion.

3.2 Account Information

• You agree to provide accurate, up-to-date and complete information.
• One person, one account.
• Accounts on behalf of legal entities are not permitted; the App is for natural persons only.
• You are solely responsible for keeping your password / SMS verification code confidential.
• You are responsible for all activity under your account. Notify raif@rekastudios.com immediately if you suspect unauthorised access.

3.3 Identity Verification

For security or legal reasons we may request additional identity verification or temporarily suspend an account.

4. User Obligations and Prohibited Conduct

The following are strictly prohibited and will result in immediate suspension or termination:

4.1 Content Restrictions

• Sexual, obscene, or nudity-containing photos or text
• Violent, hateful, racist or discriminatory content
• Promotion of illegal substances, weapons or smuggling
• Copyright-infringing material
• Advertising, spam, MLM, gambling promotion
• Malware, viruses, phishing links

4.2 Behaviour Restrictions

• Harassing, threatening, insulting or stalking another user
• Creating fake profiles or impersonating someone else
• Using fake or unauthorised photographs of other people
• Repeatedly cancelling or being a no-show at gatherings
• Using the App to redirect users to other platforms
• Soliciting commercial offers (escort, sales, marketing) to other users
• Inviting, grooming or exposing minors under 17

4.3 Technical Restrictions

• Reverse engineering, decompiling or disassembling the App
• Using bots, automated scripts or scrapers
• Attempting denial-of-service or exploiting vulnerabilities
• Collecting other users' data without authorisation

We reserve the right to remove content, suspend or permanently terminate accounts and notify authorities without prior notice when violations are detected.

5. Gathering Rules

5.1 Organiser Responsibility

• The user who creates a gathering (organiser) is responsible for venue accuracy and event execution.
• Venue reservations are the organiser's responsibility; Minfour does not make reservations.
• A user may have at most 5 active gatherings at the same time.

5.2 Participation and Cancellation

• Gatherings that fail to reach the 4-person minimum are auto-cancelled 2 hours before start.
• Cancellation more than 6 hours in advance: free.
• Cancellation 2–6 hours in advance: warning point.
• Cancellation under 2 hours or no-show: penalty point.
• 3 penalty points: 1-week account restriction. Repeated offences may result in permanent ban.

5.3 Safety

Minfour cannot guarantee physical safety at meet-ups. When meeting strangers we recommend you:

• Choose busy public venues.
• Share your location with someone you trust.
• Drink responsibly.
• Contact raif@rekastudios.com or local authorities in case of harm.

6. Content Rights

6.1 User Content

You retain ownership of the photos, text, messages and other content you upload. By uploading you grant Minfour a worldwide, royalty-free, sublicensable, transferable licence to host, store, reproduce, display and transmit your content as needed to operate the Service. The licence ends when you delete the content; backups may take up to 30 days to fully purge.

6.2 Minfour Brand and Software

The Minfour name, logo, design, source code and database structure are owned by REKA YAZILIM TURIZM TICARET VE SANAYI A.S.. They may not be copied, distributed or used to create derivative works without written permission.

7. Premium Subscription

7.1 Plans and Pricing

• Monthly plan: ₺79 / month
• Yearly plan: ₺699 / year

Prices include applicable taxes and may vary by region. The current price is shown by Apple App Store or Google Play at purchase.

7.2 Premium Features

• Unlimited gathering participation / creation
• Verified badge
• See who viewed your profile
• Access to premium events
• Priority customer support

7.3 Auto-Renewal

Subscriptions renew automatically at the end of each period. To stop renewal, cancel at least 24 hours before the end of the current period through your Apple or Google account settings.

7.4 Refunds

• For digital goods and subscriptions, the EU 14-day right of withdrawal expires once you start using the service.
• All refunds are handled by Apple App Store or Google Play according to their policies. Minfour does not process refunds directly.

7.5 Termination of Subscription

If you cancel, you keep premium features until the end of the current period. If we terminate your account for breach of these Terms, no refund is owed for the unused period.

8. Account Termination

8.1 By You

At any time via Profile → Settings → "Delete My Account". Your data will be anonymised or deleted within 30 days.

8.2 By Us

We may suspend or terminate your account if:

• You breach this Agreement
• You use the App unlawfully
• We receive serious, verified complaints from other users
• The account is inactive for more than 12 months

9. Disclaimers

9.1 "As Is" Service

The Service is provided "as is" and "as available". We do not warrant that the Service will be uninterrupted, error-free, fully accurate or fit for any particular purpose.

9.2 Limitation of Liability

To the maximum extent permitted by law, Minfour is not liable for:

• Physical, material or moral harm during meet-ups
• Acts or statements of other users
• Payment or service disputes between users
• Outages of third-party providers (Firebase, Apple, Google)
• Loss of data, revenue, or any indirect or punitive damages

Our total liability shall in no event exceed the amount you paid for premium subscription in the past 12 months.

9.3 Exceptions

The above limitations do not apply to gross negligence, wilful misconduct or rights that cannot be limited by law.

10. Notices

We will send you notices via:

• in-app push notification
• the email address on file
• in-app message centre

A notice is deemed delivered when sent.

11. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the Republic of Türkiye. Disputes are subject to the Istanbul Çağlayan Courts and Enforcement Offices.

If you act as a consumer, you retain your right to apply to your local Consumer Arbitration Committee or Consumer Court.

EU users may also use the EU Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr).

12. Changes to the Agreement

We may update this Agreement unilaterally. Material changes will be announced at least 15 days in advance via:

• in-app notification,
• email, and
• updating the "Last updated" date.

If you do not accept the changes, you may delete your account; otherwise continued use constitutes acceptance.

13. Miscellaneous

• Entire Agreement: This Agreement is the entire agreement between the parties.
• Severability: If any provision is invalid, the remainder remains in force.
• Assignment: You may not assign your rights to third parties.
• Waiver: Failure to enforce a right is not a waiver of it.
• Apple & Google: Apple Inc. and Google LLC are not parties to this Agreement but may enforce its terms as third-party beneficiaries.
